DMCA Policy
Applesauce Spice Cupcakes ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.
This policy outlines the information required to submit a copyright infringement notice and how we handle such claims. It also details the process for submitting a counter-notification if your content has been removed due to a DMCA claim.
Filing a Notice of Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via Applesauce Spice Cupcakes, please notify our designated Copyright Agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work that you claim has been infringed;
- Identification of the material that is claimed to be infringing and where it is located on the Applesauce Spice Cupcakes website/platform;
- Information reasonably sufficient to permit Applesauce Spice Cupcakes to contact you, such as your address, telephone number, and e-mail address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Failure to include all of the above information may result in a delay in processing or an inability to process your notice. Upon receipt of a valid notice, we will remove or disable access to the infringing content and notify the user who posted the content.
Counter-Notification Procedures
If your content has been removed from Applesauce Spice Cupcakes due to a copyright infringement notice, and you believe that the material was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes substantially the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
- Your name, address, and telephone number; and
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Applesauce Spice Cupcakes may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, we will provide the complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it within 10 business days. Unless our Designated Copyright Agent receives notice from the complaining party that an action has been filed seeking a court order to restrain the user from engaging in infringing activity related to the material on Applesauce Spice Cupcakes, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.
